Not entirely.  The debate about the enforceability of software licenses
is still very much alive.  ProCD v. Zeidenberg made it's way to an
appeals court, which ruled that software licenses are enforceable.  The
case was in an appeals court because, well, it was being appealed.
I.E. - a district court found otherwise.  Until a case such as this
wends it way all the way to the Supreme Court, there will always be room
for disagreement on this issue.

This is a different point than whether a license is a contract, but
related nonetheless.
