Honestly, I think it's a really bad move for FSF to announce something like this (even if it's a 'leak') without presenting hard-and-fast reasoning for the possibility. I think the original poster attempted to point to the fact that the article really didn't present any sort of legal justification for the apparent threat (I know I didn't see any), so I can't say if it's valid or not. By doing so, I think that FSF is as guilty as Microsoft of FUD-slinging.
