There's one HUGE difference between the FCC ruling the GPL to be unenforceable and the FCC ruling Microsoft's licenses to be unenforceable -- The amount of money Microsoft could spend on lawyers to bludgeon the FCC into submission is astronomical compared to the amount of money FSF could spend on lawyers!
